Difference Between ACT AND CODE

When asked this question, most of us think that one of them is superior than other

To understand the difference one must know

That Any Law can be made in form of

ACT

Rule

Regulation

Code

Ordinance

Case Laws

So basically ACT and Code are both form of statutory laws, passed by the Parliament, obtained president assent and get published in the official gazette.

Then what makes the difference between them?

*ACT -A bill passed by legislature becomes an act and enforceable by law. So Basically it contains the law in form of sections. When you read an Act , you will find the law divided in sections .

Rather when you go through a Complete Law you will find Act, Rules and Regulations.

*Talking about Code – When there are numerous existing laws in relation to one subject and if further they are consolidated and classified under one roof ,thats a code .

While forming code the legislature may amend or delete some existing laws as to the need of current and future scenario and bring all the laws under one umbrella

Generally a Code is created for procedural laws ,like bringing all procedures at one place .

1- Code of Civil Procedure 1908

2- Code ofCriminal Procedure 1973

3-Insolvency and Bankruptcy Code 2016
